Limited Liability

  1. Although Apolix makes every effort to offer a reliable uninterrupted service, Apolix will not be held liable for any damage incurred directly or indirectly through service interruption.
  2. Apolix will not be held liable for the loss of a domain due to late payment by the client.
  3. While Apolix makes every effort to ensure the efficiency and reliability of Anti-Spam systems, we will not be held liable for any loss of data or income due to a virus infection or email that is incorrectly classed as SPAM but is not.
  4. Apolix reserves the right to block mail addresses, domains, ip addresses and netblocks of ip addresses should services originating from mail addresses, domains, ip addresses or netblocks cause
    1. a degradation of Apolix's services;
    2. an annoyance to other members of Apolix's client base;
    3. the integrity of Apolix's security to be compromised;
  5. Apolix reserves the right to remove any content hosted by on their infrastructure which it considers illegal or for which it has received a legitimate take-down notice.
  6. Apolix maintains backups of client data to aid disaster recovery, and will endeavour to restore lost data, however, it will not be held liable should the restore not be successful or up to date.

Payments

  1. Apolix offers two payment methods, debit order and invoice. If invoice is selected as the method of payment, a deposit equal to the cost of six months worth of subscribed services may be required. The deposit is refundable on cancellation . Interest does not accrue on the amounts deposited.
  2. Standard payment terms are 21 days from the date of invoice, Apolix reserves the right to suspend service until the amount is settled or payment arrangements have been made. Failed debit orders incur an admin fee of R50 inclusive of VAT. Apolix reserves the right to reprocess failed debit orders at any time for the outstanding amount or any part thereof.
  3. Apolix will charge prime+3% on all overdue account
  4. Cheques are not accepted.

Conduct

  1. Apolix customers must not knowingly create, store or disseminate any illegal content
  2. Apolix customers are required to abide by the AUP at all times.

Termination

  1. Terminations are effective on the last day of the month and all invoices for services must be paid up to the date of termination.
  2. Termination requests must reach Apolix no later that the 5th day of the month of termination and must contain: Your name and ID number, as well as a list of all the services you would like to cancel .
  3. Apolix reserves the right to withhold the transfer of domains and other services to a new provider if payments are outstanding.

Breech

  1. Apolix reserves the right to suspend or terminate the service of any customer that fails to comply with the Terms & Conditions, Acceptable Use Policy or any other contractual obligations.
